Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the ConvertDriveways platform, including our website, widgets, APIs, and any related services (collectively, the "Services"). By registering for an account, accessing, or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

ConvertDriveways ("ConvertDriveways", "we", "us", or "our") is a trading name of Rhys Morgan, a sole trader based in England. Our business address is 4th Floor, Silverstream House, 45 Fitzroy Street, Fitzrovia, London, W1T 6EB, United Kingdom.

2. Eligibility

You must be at least 18 years old and legally capable of entering into contracts to use our Services. By using ConvertDriveways, you represent and warrant that you meet these requirements and that all information you provide is accurate, complete, and current.

Our Services are designed specifically for UK driveway contractors, installers, and related trade professionals. You agree to use the Services only for lawful business purposes related to your trade.

3. Account Registration and Security

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use or security breach.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably suspect are being used fraudulently or maliciously.

4. Subscription and Payments

ConvertDriveways operates on a subscription basis. Fees are billed in advance on a monthly or annual basis, as selected by you. All payments are processed securely through our payment provider.

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time through your account settings. No refunds are provided for partial billing periods, except where required by law.

We reserve the right to change our pricing upon reasonable notice. Price changes will take effect at the next billing cycle following notification.

4a. Refunds and Complaints

14-day cooling-off period. If you are a new customer and have not yet generated any AI visualisations or captured any leads, you may cancel within 14 days of your first paid invoice for a full refund. Once the Services have been materially used, this cooling-off right is exhausted in line with the Consumer Contracts Regulations 2013.

Service failure refunds. If the Services are unavailable for more than 48 consecutive hours due to a fault on our side, you may request a pro-rata credit against your next invoice. Email team@convertdriveways.co.uk with your account email and the affected dates.

How to raise a complaint. Send the details to team@convertdriveways.co.uk with the subject line "Complaint". We aim to acknowledge within 2 working days and provide a substantive response within 10 working days. If we cannot resolve the matter, you may escalate to an alternative dispute resolution body or the courts of England and Wales.

Chargebacks. Please contact us before initiating a chargeback with your bank. Most billing disputes can be resolved directly and faster than via the card scheme process.

5. Acceptable Use

You agree not to use the Services to:

  • Upload, generate, or distribute content that is unlawful, harmful, threatening, defamatory, or otherwise objectionable;
  • Infringe upon the intellectual property rights of others;
  • Attempt to reverse engineer, decompile, or otherwise extract source code from the Services;
  • Use automated systems or software to extract data from the Services ("scraping") without our written consent;
  • Interfere with or disrupt the integrity or performance of the Services;
  • Misrepresent the identity of a business or individual.

5a. Photos and Homeowner Consent

Some of our Services let you (or homeowners using your embedded widget) upload photos of a property. By uploading a photo, you confirm that you either own the property shown or have the property owner's permission to upload, process and store that image for the purpose of generating a visualisation and quote.

You agree not to upload images that contain identifiable third parties (faces, number plates, children) without their consent. You can request deletion of any uploaded image at any time by emailing team@convertdriveways.co.uk. See our Privacy Policy for retention, processing and your rights.

6. Intellectual Property

All content, software, designs, and materials provided through the Services are owned by ConvertDriveways or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any images, branding, or content you upload. By uploading content, you grant us a limited licence to use, process, and display that content solely for the purpose of providing the Services to you.

AI-generated visualisations created through our platform are provided for your commercial use in connection with your driveway business. You may not resell, redistribute, or use generated images for purposes unrelated to your trade without our prior written consent.

7. Data and Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Services, you consent to the practices described therein.

8. AI-Generated Content Disclaimer

The visualisations generated by our AI are produced algorithmically and are intended as illustrative representations only. While we strive for accuracy, results may vary depending on input image quality, lighting, and other factors.

We do not guarantee that generated images will precisely match the final installed appearance of any driveway material. Always consult with your supplier or installer for material samples and specifications before making purchasing decisions.

9. Limitation of Liability

To the maximum extent permitted by applicable law, ConvertDriveways shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or in connection with your use of the Services.

Our total liability for any claim arising under these Terms shall not exceed the total amount paid by you to ConvertDriveways in the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.

10. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including intellectual property rights, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Services at least 30 days before they take effect. Your continued use of the Services after such changes constitutes acceptance of the revised Terms.
